RULES FOR THE CONTEST
- Tata DOCOMO brand signature tune has been uploaded on create.tatadocomo.com/music.aspx Participants can download the Tata DOCOMO brand signature tune from this link to take part in this Contest.
- Participants need to create original brand signature tunes by creating them basis the brief provided on the website. No clarifications or additional details will be given to any participant on the brief and no communication in this regard will be entertained.
- The length of the entries created should be between 30 - 60 seconds only.
- Participants need to upload their entry in the requisite software format (as specified in the brief) on the designated section of the website. Request for submission of entries in any other manner or form will not be entertained.
- Participant needs to fill-up the entry form completely and correctly before uploading his entry. Incomplete forms will be summarily rejected and entries with false information (detected at any stage including after acceptance of the entry) will be summarily rejected and liable for penal action.
- An individual can submit as many entries that he wants.
- Participant will have to sign-up an undertaking declaring that the work being uploaded by him is his own creative work and that he will indemnify Tata DOCOMO against any plagiarism claims, at any stage, on the work submitted by him.
- This Contest is open to individuals only. Corporate, Agencies, employees of TTSL, its business associates and their immediate family members are not allowed to take part in this Contest.
- Entries once submitted cannot be recalled or modified under any circumstances. No communication in this regard will be entertained.
- Tata DOCOMO nominated jury will evaluate the entries and its decision on the winning entry, if any, will be final and binding.
- The winning entry will become a copyright of Tata DOCOMO and the company will have all rights to use the winning entry (s) in whichever forums, media and frequency it deems appropriate, without any financial or any other obligation whatsoever.
- The contest will be open from 14th Jan 2010 until 31st March 2010 only. Late entries will not be accepted and no communication in this regard will be entertained.
- One winning entry, will get a cash award of INR 1,00,000 (subject to tax deduction as per the tax laws) and 10 shortlisted entries (subject to tax deduction as per the tax laws) will receive a cash reward if INR 10,000 each. Further the winning entry as well as the shortlisted entries, may be showcased by Tata DOCOMO, at its own expense, on Television, Online or any other media as per its sole discretion for its promoting its brand, products, business or any other objective it deems fit.
- Participant, with the winning entry, shall make himself available for various PR initiatives around the Contest at the appointed date, time and place as requested by Tata DOCOMO.
TERMS AND CONDITIONS OF THE CONTEST
- The Contest is open to all individuals who are Indian citizens, aged 18 years and above.
- There is no entry fee for participation in the Contest. Tata Teleservices Limited (TTSL) does not require any payment for entry into the Contest nor does TTSL offer any form of payment, actual or implied or any assured prize to the participants, for participation in the Contest
- The Contest is not open for the employees of TTSL, their business associates and their immediate family members
- The participant, as a "pre-condition" to the Contest, has to download the Tata DOCOMO brand signature tune from the create.tatadocomo.com link
- The Participant with his own creativity skills needs to create original brand signature tune with "DO, DO, DO", as the opening line and ending with DOCOMO, using any raga and style of his choice, get the tune recorded and then submit the entry in Mp3 format.
- The length of the entry should be between 30 seconds to 60 seconds
- The participant may choose to send more than one entry.
- The participants may choose to play for any number of days during the Contest period and there is no requirement to play on all days of the Contest period
- The Contest is in the form of selection of one entry at the end of the Contest period as "winning entry" by the panel of jury from music fraternity, as appointed by TTSL
- The participant has to submit an undertaking along with his entry, acknowledging that the work submitted by him is original and does not infringe third party intellectual property and that he will indemnify TTSL against any claims that may arise regarding ownership or any other claims in respect thereof.
- The participants acknowledge that all the copyrights rights and intellectual property rights in the work, post of entry would entirely and solely vest with TTSL. By submitting the entry for the Contest, the participant agrees to assign and transfer all copyrights in the work to TTSL without any consideration and compensation and any other additional formalities.
- The participants must agree to abide by the Terms and Conditions as described here.
- Any disputes with respect to the Contest shall be subject to the jurisdiction of courts of Delhi only.
- The participants are not permitted to submit entry on behalf of any other individual or entity.
- The entries must conform to decency guidelines. Any work deemed to convey a content that depicts violence, racial, political, religious, and sexual or any other inflammatory, defamatory or objectionable material in an inappropriate manner will be disqualified and removed. TTSL reserves the right to initiate legal action against such participants. Interpretation of what is, and is not, appropriate material is at the sole discretion of TTSL. .
- Neither TTSL nor the associate sponsor (if any) for the Contest will be held responsible for late entries for any reason whatsoever. It is the sole responsibility of the participants to make reasonable allowances for upload time, bandwidth connectivity or Internet issues and plan their submissions accordingly.
- The entries will be judged on creative and originality merit . The interpretation of these rules and creative, merit of the work and any other consideration made by the judges is at the sole discretion of the judges.
- The winner will be intimated within 7 days of the conclusion of Contest period, by posting his names on the Tata DOCOMO website and by way of email on the email id provided by the winner. In the event of no response/acknowledgement from the concerned winner to the email communication within 15 days, then his prize will be forfeited.
- The winner should submit the necessary redemption documents to TTSL, within 14 days from the acknowledgement of the TTSL communication as referred above, by the winner.
- The prize will be distributed/delivered to the winner by TTSL, within 30 days of receipt of all necessary redemption documents by TTSL from the winner, at the respective address of the winner. If the winner absents from taking the delivery of the prize and fails to collect the same within 45 days from submission of redemption documents, then his prize stands forfeited.
- It is the responsibility of the participants to inform TTSL of any change in the address of correspondence, for availing the prize
- TTSL shall have the right to use all entries , in any media for brand, products, business or any other objective as it may deem fit. TTSL also reserves the right to display all entries on any medium (Online, TV etc) or vehicle it deems appropriate.
- The participant assumes all responsibility and costs for delivering the entry and other required information to TTSL for evaluation in the Contest.
- There is no chance component in the selection of winning entries. The winning entries will be chosen solely on the skill exhibited by the participants as determined solely by the jury appointed by TTSL
- TTSL will take reasonable measures to ensure the security of entries and information supplied in them. In no event shall TTSL be liable to any party, for damages / compensation arising out of any loss of entry and data supplied.
- TTSL reserves the right to suspend, shorten, modify or cancel the Contest at its sole discretion by intimation on Tata DOCOMO website.
- TTSL will have no liability in case someone is not able to participate on account of his inability to download logos or music from the designated section of the website. No correspondence in this regard will be entertained.
- TTSL is not responsible for participant not being able understand the brief or for his interpretation of the same. No correspondence in this regard will be entertained.
- TTSL is not responsible if the uploaded work does not play and hence the entry is not part of the list for evaluation by the jury.
- Any private correspondence or canvassing in any form will lead to rejection of the entry submitted by the participant.
- The participant cannot post same or similar entry as submitted for the Contest at any other blog/forum or any site .
- TTSL will not be held responsible if the communication pertaining to the winning entries doesn't reach intended contestants for any of the following reasons as mentioned:-
- Incorrect e-mail address given at the time of submitting entry
- Inbox of the recipient being full / having insufficient space
- Bandwidth problem of the mailbox / server or the host
- Time lapse
- Any other reason, technical or otherwise, beyond the control of TTSL
- The Contest is open from 14th Jan 2010 until 31st March 2010
- The prizes are non-endorsable, not transferable and non-substitutable. The prizes are offered on 'NO EXCHANGE NO REFUND' basis.
- TTSL will entertain no requests for exchange in lieu of the prize/s.
- Apart from the entitlement to the above prize/s, the winner and/or his legal heirs will have no other rights or claims against TTSL
- To process redemption, each winner should declare his name, address and provide proof of identity.
- The prize/s shall be subject to the laws of India, including all the tax laws. All applicable regulatory and statutory duties, cess, surcharges, taxes (including TDS), insurances, transfer fees, registration fees etc. that may be applicable to avail the prize will be borne by the winner.
- TTSL shall not be liable for any failure to comply with its obligations caused by weather conditions, fire, flood, strike, hurricane, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, acts of God or any other circumstances amounting to Force Majeure.
- TTSL shall not be responsible for any loss or damage if it has to discontinue or cancel this Contest in compliance with any law, ruling, order, regulation, requirement or instruction of any Central/State Government or for any other unavoidable reason beyond its control. The participants shall be informed of such discontinuance/cancellation as soon as possible, through the Tata DOCOMO website.
- The judges have sole discretion in the interpretation of the Contest rules. The Judges' decisions are final and no correspondence will be entertained in that regard.
- TTSL can get general public to vote on the various entries submitted by the participants at its sole discretion, to determine the winning entry, in addition to the judgment of the panel of experts.. Organized voting will lead to summary disqualification of the participant/entry.
